§1 Scope of Application

These Terms and Conditions apply to all purchase agreements concluded via our online shop at the domain www.lucidreams.de.

§2 Subject of the Contract

The products listed in our webshop represent a non-binding product catalogue.

§3 Conclusion of Contract

Customers can place products into their cart by clicking the "Add to Cart" button, provided the item is in stock. By clicking the "Place Order" button, the customer submits a binding offer to purchase the items in the cart. Confirmation of the order and acceptance of the contract is sent automatically via email immediately after checkout.

Before submitting the order, customers may review and edit the items and personal information provided during the checkout process.

§4 Prices and Payment

All prices are gross prices and include all applicable taxes, including VAT. Shipping costs are shown separately and can be found under “Shipping.” The total shipping costs will be displayed before finalizing the order.

Available payment methods: PayPal, prepayment (bank transfer), and Klarna.

§5 Right of Withdrawal

Private customers (consumers) have the statutory right to withdraw from distance sales contracts. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.

Details on the withdrawal policy, including conditions, time limits, and procedures for exercising the right of withdrawal, as well as a model withdrawal form, are available under the “Withdrawal Policy” section.

The right of withdrawal does not apply to:

  • Sealed goods that are not suitable for return due to health protection or hygiene reasons once the seal has been removed.

  • Opened and used cosmetics that are applied directly to the body (e.g., lipsticks).

We ask customers to carefully consider whether they wish to keep the item before use.

§6 Shipping

Products will be shipped within 3–8 business days after payment is received.

§7 Warranty for Defects

Customer rights regarding product defects are governed by statutory regulations.

§8 Disclaimer of Liability

Claims for damages by the customer are excluded unless they concern injury to life, body, or health, or are based on intentional or grossly negligent breach of duty on our part or by our agents.

The limitation of liability does not apply to essential contractual obligations that enable proper contract execution and on which the customer regularly relies. In such cases, liability is limited to foreseeable and typical damage unless it involves injury to life, body, or health.

§9 Retention of Title / Set-off

If the customer is a consumer, we retain ownership of the purchased goods until full payment is made. If the customer is a business, legal entity under public law, or a special fund under public law, we retain ownership until all claims arising from the business relationship have been settled. These security rights may be transferred to third parties.

Customers may only set off claims that are undisputed or legally established and directly related to the contractual relationship.

§10 Storage of Contract Text

We store the contract text and the customer’s order data required for processing the sale. These will not be shared with third parties without authorization and will be deleted once the contract is fulfilled and legal warranty obligations have expired. Customers may contact us at any time to inquire about stored data.

§11 Final Provisions

All contracts are subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this applies only if it does not restrict mandatory consumer protection provisions in their country of residence (favorability principle). For business transactions, the place of jurisdiction is our registered business address.
